IMPORTANT NOTE: Section 1557 of the Affordable Care Act and related regulations require that any important patient communications include (1) certain notice language regarding non-discrimination and (2) taglines providing information about language assistance services for individuals with limited English language proficiency. HAP’s Patient Rights and Responsibility Brochure (the “Brochure”) does not include the required taglines as they must be tailored to the needs of each individual hospital. Accordingly, your hospital must add the appropriate hospital-specific taglines to the Brochure before distributing it to patients. We also note that the Brochure includes notice language for use in a pamphlet communication, but a more extensive notice may be required if the hospital changes the formatting of the information (for example, by providing the information to patients on an 8 ½” x 11” printout rather than in brochure/pamphlet form). It is your hospital’s responsibility to make sure that you comply with the Section 1557 requirements in your distribution of this information regarding patient rights.

HAP shall not be responsible for any changes made by the hospital or any other party to the information and language provided in HAP’s Brochure. You agree to remove all references to HAP, including but not limited to the HAP logo and name, in the event that you make any modifications to the language or formatting of the Brochure, other than to add required Section 1557 taglines. Finally, HAP notes that the content of the Brochure may be affected by subsequent changes in the law. HAP will make best efforts to update the Brochure as needed.
